Terms of Service

Welcome to FitLinkPro! These Terms of Service ("Terms") govern your use of the FitLinkPro mobile application and related services (collectively, the "Service") operated by FitLinkPro ("we," "us," or "our").

1. Acceptance of Terms

By downloading, installing, or using FitLinkPro, you agree to be bound by these Terms and our Privacy Policy. These Terms apply to all users of the Service, including trainers and athletes.

2. Description of Service

FitLinkPro is a fitness coaching platform that enables:

• Personal trainers to manage clients, create workouts, and track progress
• Athletes to track their fitness journey and connect with trainers
• Workout planning, exercise libraries, and progress analytics
• Data synchronization and backup services (for premium users)

3. User Accounts

Account Creation

• You may create an account using Apple Sign-in or continue using the app offline
• You must provide accurate and complete information
• You are responsible for maintaining the security of your account
• You must be at least 13 years old to create an account

Account Responsibilities

• You are responsible for all activities under your account
• Notify us immediately of any unauthorized access
• Do not share your account credentials
• Maintain accurate and up-to-date account information

4. Subscriptions and Payments

Subscription Plans

• Free: Basic features with limitations
• Premium: Full access to all features (monthly/yearly options)

Payment Terms

• Payment will be charged to your Apple ID account at confirmation of purchase
• Subscriptions are billed through your Apple App Store account
• Payments are charged at the time of purchase and at the start of each billing period
• Prices are subject to change with 30 days notice
• All fees are non-refundable except as required by law

Auto-Renewal

• Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel your subscription by going to your Account Settings on your device after purchase
• Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription

Refunds

All purchases, billing, and refunds are handled by Apple. For refund requests, please contact Apple Support in accordance with the Apple Media Services Terms.

5. Acceptable Use

You May:

• Use FitLinkPro for legitimate fitness coaching and training purposes
• Create and share workout content with your clients
• Store and manage fitness data
• Use the Service in accordance with these Terms

You May Not:

• Use the Service for any illegal or unauthorized purpose
• Violate any laws in your jurisdiction
• Transmit harmful, offensive, or inappropriate content
• Attempt to gain unauthorized access to the Service
• Reverse engineer, modify, or create derivative works
• Use automated systems to access the Service
• Impersonate others or provide false information

6. Content and Data

Your Content

• You retain ownership of content you create in FitLinkPro
• You grant us a license to store, process, and display your content to provide the Service
• You are responsible for ensuring your content doesn't violate any rights
• We may remove content that violates these Terms

Our Content

• FitLinkPro and its content are protected by intellectual property laws
• You may not copy, modify, or distribute our content without permission
• Exercise databases and templates remain our property

7. Privacy and Data Protection

• Your privacy is important to us. Please review our Privacy Policy
• We implement security measures to protect your data
• You control your data and can export or delete it anytime
• We comply with applicable data protection laws

8. Disclaimers

Service Availability

• We strive for high availability but cannot guarantee uninterrupted service
• The Service is provided "as is" without warranties
• We may update, modify, or discontinue features
• Your data is your responsibility - maintain your own backups

9. Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid for the Service
• We are not liable for third-party actions or content
• Some jurisdictions may not allow these limitations

10. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or costs arising from:

• Your use of the Service
• Your violation of these Terms
• Your content or activities
• Your violation of any third-party rights

11. Termination

By You

• You may stop using FitLinkPro anytime
• Cancel subscriptions through your App Store account
• Request account deletion through the app settings

By Us

• We may terminate accounts for Terms violations
• We may discontinue the Service with reasonable notice
• Upon termination, your right to use the Service ends immediately

12. Governing Law

These Terms are governed by the laws of the Republic of Armenia. Any disputes will be resolved in the courts of the Republic of Armenia.

13. Changes to Terms

• We may update these Terms from time to time
• We'll notify you of material changes through the app
• Continued use constitutes acceptance of updated Terms
• If you don't agree to changes, please stop using the Service

14. Apple App Store

If you download FitLinkPro from the Apple App Store, you acknowledge that:

• These Terms are between you and FitLinkPro, not Apple
• Apple is not responsible for the Service or its content
• Apple has no obligation to provide support for the Service
• Apple is a third-party beneficiary and may enforce these Terms

Apple End User License

Your license to use the iOS app is granted under the Apple Media Services Terms, including the Apple Standard EULA. If any terms here conflict with the Apple Standard EULA, the Apple Standard EULA will govern for iOS users.

15. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and FitLinkPro regarding the Service.

By using FitLinkPro, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
